Rhetorik Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs your use of the services offered by Rhetorik Limited. and its affiliates (“Services”) and our website(s) including https://rhetorik.com (“Rhetorik Site”). We may modify this Policy by posting a revised version on the Rhetorik Site. By using the Services or accessing the Rhetorik Site, you agree to the latest version of this Policy.
You may not use, facilitate or allow others to use, the Services, the Licensed Data or the Rhetorik Site:
- for any illegal or fraudulent activity;
- to violate the rights of others;
- to threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm;
- for any content or activity that promotes child sexual exploitation or abuse;
- to violate the security, integrity, or availability of any user, network, computer or communications system, software application, or network or computing device;
- to distribute, publish, send, or facilitate the sending of unsolicited mass emails or other messages, promotions, advertising, or solicitations (or “spam”).
- for any form of debt collection.
- directly as the sole source of data for hard background check purposes.
- to determine eligibility for a government license or benefit.
- for any purpose prohibited by applicable data privacy and security laws, including the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”), the California Consumer Privacy Act or any similar state or national laws.
- for the benefit of any one political candidate, political party, political campaign or advocacy group affiliated exclusively with or formed to benefit any one political candidate, political party or political campaign.
- to benefit any government agency operating as an intelligence agency whose purpose is to collect and analyze data on people for the purposes of, but not limited to, counter-terrorism, the creation of watchlists, individual threat assessment or mass-surveillance to support national security, military, and foreign policy objectives. Providers to intelligence agencies are also prohibited from providing our data to any governmental intelligence agency undertaking these or similar activities.
- For any evidentiary purpose related to law enforcement or criminal prosecution, such as to establish as an evidentiary matter that a particular person is associated with a particular data element (as you understand that such data elements may be subject to errors in accuracy, currency or transcription), provided that (subject to the foregoing restriction) such data may be used for investigative, analytics or validation purposes;
- in connection with any purpose covered by the Fair Credit Reporting Act (15 U.S.C. Sec. 1681 et seq ((“FCRA”))), Federal Trade Commission interpretations of the FCRA, and similar federal and state statutes including for any purposes enumerated in the FCRA in lieu of obtaining a Consumer Report; or use or provide services or data provided by Rhetorik for the preparation of a Consumer Report or in such a manner that may cause such data to be characterized as a Consumer Report.
Investigation and Enforcement
We may investigate any suspected violation of this Policy, and remove or disable access to any content or resource that violates this Policy. You agree to cooperate with us to remedy any violation.
When determining whether there has been a violation of this Policy, we may consider your ability and willingness to comply with this Policy, including the policies and processes you have in place to prevent or identify and remove any prohibited content or activity.
